Standard Terms and Conditions
 

After registering as an author and transferring the annual subscription and usage fee of €25 (incl. VAT) if from a country in the EU or 25£ (incl. VAT) if from Great Britain or the USA, the depositor has the right to send in ideas to the Creativbox webpage either under the category “authors wanted” or “advertising ideas wanted” as according to our guidelines.

Furthermore, the author can make use of all other Creativbox services such as the Market Place and the Opinion Forum as well as those described in our information details. For a full year, all these privileges are included in the amount listed above.
Creativbox retains the right to delete from all our services eventual entries of immoral, racist, criminal or ethically unacceptable content.

After receiving your payment, you will be issued a password, which will entitle you to log in. After your initial log in, you will be able to change your password.
You will have the right to use the services of the Creativbox for one year from the date the payment has been received in the Creativbox account. The Author has the right to also use all the offered services by the Creativbox, for example the marketplace and opinion platform.

The Creativbox has the right to remove any entries which contain offensive immoral or racist themes.

After registering as an author, the submitting party is eligible to send in ideas to the Creativbox website in compliance with the given guidelines either under the heading “Authors Wanted” or “Advertising Ideas Wanted”.

The submitted work should not exceed 4 DIN A4 pages (type size 12 with 1.5 spacing).

Creativbox is not obliged to pass on the submitted work.

We expressly emphasize that Creativbox cannot guarantee that a broadcasting station or agency will actually implement your idea or concept even after having passed our selection procedure.

Creativbox will acknowledge the submission of an idea or concept immediately upon receipt via return email. This ensures that the submitting party is protected under copyright regulations and also provides a safeguard for Creativbox should these ideas and concepts be passed on to broadcasting stations or agencies. Thus in sum we have doubled our protection by working together.

By submitting work to Creativbox the submitting party gives Creativbox the exclusive right to examine the submitted ideas and, following a selection procedure, to decide whether or not the submitted ideas should be passed on to broadcasting stations or agencies.
This decision shall be made by several persons who together determine whether the idea is up-to-date, already exists or has already been realized.

After the selection procedure, Creativbox will immediately inform the submitting party whether his idea has been passed on.

  1. a. If the idea, for whatever reason, is not passed on, the reasons shall be explained to you via feedback on the website.
  2. b. If the idea or concept is passed on, you shall also be notified as quickly as possible via feedback on the website.

Creativbox will pass on ideas and concepts to TV broadcasting stations and agencies on the 15th of each month. Current advertising requests will be dealt with immediately.
After passing on ideas or concepts, Creativbox will contact the broadcasting stations and agencies to ask for their opinion. At this point we would like to emphasize that we have no control over how much time will pass before we receive a return answer. Therefore, Creativbox cannot guarantee any fixed time schedules.
However, Creativbox endeavours to receive answers as quickly as possible in order to be able to inform the submitting party of a decision as soon as possible.
If a broadcasting station or an agency shows interest, the submitting party shall be informed via feedback on the website or by e-mail and Creativbox will begin negotiations with the TV broadcasting station or agency.

Talks will first centre on the broadcasting station or agency’s interest in the idea or concept as such, i.e. do they like the idea or concept as it is or do they require changes or more details.
By submitting work to Creativbox, the submitting party explicitly gives Creativbox the right to sell his work to interested parties. Publication rights are generally retained by the submitting party.
If interested parties wish to adopt the submitted idea, Creativbox will negotiate a selling price. Creativbox negotiates in the name of and at the cost of the submitting party. In this case the submitting party shall be informed by e-mail. If a selling price is agreed upon and a contract is made, the submitting party shall receive 70% of the selling price and Creativbox 30% as commission.
If a broadcasting station or agency shows interest, but demands changes, modifications or more details, Creativbox shall contact the submitting party to discuss further proceedings.
If a broadcasting station or agency to which an idea has been passed on violates the submitting party’s copyright, the submitting party expressly renounces the right to hold Creativbox liable for any damages arising thereof.
This legal transaction as well as all claims arising therefrom shall be subject exclusively to Austrian law. Place of performance and jurisdiction for both contracting parties shall be Salzburg. Alterations and/or amendments to our contracts must be in writing. Oral agreements shall be invalid.
The submitting party acknowledges that his data will be processed automatically within our company and gives his explicit approval thereto.
